This action arises out of a public construction contract entered into between the plaintiff, John J. Petruzzi-William E. Forrester, Inc. (“Petruzzi-Forrester”), and the defendant, the Massachusetts Turnpike Authority (“MTA”), for rock and earth excavation and the stabilization and construction of boulder walls and ditches.
