This appeal is from a judgment of the Circuit Court of Jasper County affirming an order of the County Court of Jasper County denying a petition under § 72.080 for incorporating the City of Duquesne as a city of the fourth class. (Statutory references are to R.S.Mo.1949 and V.A. M.S.) The case was transferred here upon petitioners’ application by the Springfield Court of Appeals because of the general interest and importance of the *859questions involved (Mo.Const. Art.
