WHEELER, Judge.

This Fair Labor Standards Act (“FLSA”) action is before the Court on the Government’s Rule 12(b)(1) motion to dismiss for lack of subject matter jurisdiction. Plaintiff Christopher Frost,' a former United States Probation Officer, filed his complaint upon which the Government’s motion is based on January 22, 2013.
