This is a suit for the recovery of benefits claimed to be due under the workmen’s compensation law. The trial court entered an order dismissing plaintiff’s petition, and plaintiff appeals.
*687On May 2, 1939, plaintiff was appointed chief of police of the city of O’Neill, Nebraska. On May 10, 1939, plaintiff went to the home of Mrs. S. J. Weekes in O’Neill in response to a call to take her to an early morning train.
