This suit was commenced in the district court of Sedgwick county by the city of Wichita, a city of the first class, against the Missouri & Kansas Telephone Company, a corporation. In plaintiff’s amended petition it was alleged that defendant was wrongfully obstructing the streets and alleys of the city by placing therein its poles and wires and by maintaining and extending its telephone system without the authority, consent or permission of the city.
