KEVIN MCNULTY, U.S.D.J.: In a previous case, Bank of Hope alleged that former employee Suk Joon “James” Ryu embezzled from the Bank. That case was voluntarily dismissed. Now in this case, Ryu alleges that the embezzlement action was a malicious use of process, among other things. The Bank moves for summary judgment on that claim, Count 1 of the Complaint.
