SWINFORD, District Judge.
This case is before me on motion of the defendant, Floyd Bruce, to vacate and correct sentences and judgments which this Court gave and entered against him on the 19th day of May 1939.
The defendant was before the Court on two indictments, Indictments No. 2086 and No. 2120. The first of these indictments contained two counts. The first count charged a violation of the Act of May 18, 1934, c. 302, 48 Stat. 782, 18 U.S.C.A. § 408e, making it unlawful for a person to move in interstate or foreign commerce to avoid prosecution for a felony or to avoid giving testimony in…
