OPINION AND ORDER

MARBLEY, District Judge.

I. INTRODUCTION

This matter is before the Court on the Motion for Partial Summary Judgment filed by Defendants Durr Environmental, Inc. (“Durr”), and Liberty Mutual Insurance Company (“Liberty Mutual”). 1 Jurisdiction is proper pursuant to 28 U.S.C. § 1332. For the following reasons, the Court GRANTS Defendants’ Motion.
