Allen Bird, herein called plaintiff, for himself, for the use and benefit of J. F. Gray and Mattie Gray, the father and mother of his deceased wife, Henrietta Gray Bird, and as next friend for Mary Katherine Bird and Jimmy Bird, who are the minor children of plaintiff and his deceased wife, instituted this suit in the District Court of Garza County, Texas against B.
