Irvin F. Snyder, as surviving trustee under the will of Frank P. Berger, brought his action in the common pleas, asking for a construction of the fifth item of the will of Frank P. Berger, deceased. He made the city of Circleville one of the parties defendant. The city filed a cross-petition, asking for a construction of the ninth item of the will.
