The petition sought the removal of the tenant for non-payment of rent and judgment for the unpaid rent. The *906tenant now asserts that the petition was insufficient to confer jurisdiction upon the court below. The proceeding was instituted,, not by the landlord owner of the premises who made the lease to the tenant, but by an assignee to whom such landlord had assigned rents with power to institute and prosecute summary proceedings: to remove tenants.
