— Appeal from an order and judgment of the Supreme Court at Special Term (Hughes, J.), entered August 3, 1983 in Ulster County, which, inter alia, denied defendant’s motion for summary judgment dismissing plaintiff’s second cause of action and granted plaintiff summary judgment on said *893cause of action for specific performance. The facts are not in dispute. Plaintiff James A. Geller, an attorney, is a general partner of plaintiff Barclay Arms Associates.
