MEMORANDUM OPINION

BIGGERS, District Judge.

The plaintiff, William Simons, brought this suit under 42 U.S.C. § 1983 (1981) and the Fourteenth Amendment to the United States Constitution, naming Roy Myers, a Columbus, Mississippi police officer, Charlie Watkins, Chief of the Columbus Police Department, the City of Columbus (City), and Fidelity and Deposit Company of Maryland (F & D), as defendants, and seeking monetary damages for the deprivation of constitutional rights.
