MEMORANDUM AND ORDER ON PLAINTIFF’S MOTION FOR PRELIMINARY INUNCTION
URBOM, Senior District Judge.
This matter is before me on the plaintiffs motion for a preliminary injunction, filing 2. The plaintiff, Dr. LeRoy Carhart, seeks to be restored in his volunteer faculty position in the Department of Pathology and Microbiology at the University of Nebraska Medical Center. A hearing on the plaintiffs motion was held on March 12 and 13, 2000. I have considered the evidence and testimony presented at the hearing and the briefs submitted by the parties. I find that the plaintiffs motion must be denied.
