The appellee, plaintiff below, sued James L. Hargis and James L. Bradley, as partners, as J. L. Hargis & 'Company. The complaint was in two paragraphs; the first on a promissory note executed by J. L. Hargis & Company to the appellee; the second was for money had and received to the use and benefit of the defendants, to pay off an indebtedness incurred in the operation and management of a large farm operated, as alleged, by the defendants as partners.
