INTRODUCTION
Plaintiff Roni Lewis (“Lewis”) filed a complaint against J.C. Penney Corporation and two of its security guards, Milton Draper and Robert Lyall, alleging race discrimination under 42 U.S.C. § 1981, violation of her Fourth Amendment rights under 42 U.S.C. § 1983, and state law causes of action including defamation, false imprisonment and intentional infliction of emotional distress.
