Appellees, partners in the stave business, upon Bayon Bartholomew, brought this suit at law against the railroad company, for damages sustained by them in May, 1879, from an obstruction of the navigation of the bayou, caused by the piers of the railroad bridge. Timbers put up to strengthen the piers had so contracted the passage, that a barge of plaintiffs’, loaded with staves could not pass on its way down to market, and the delays thereby occasioned were such, that, from the fall of the water meanwhile, the boat could not proceed.
