This action was brought by plaintiff for the return of one month’s rent and a security deposit totaling $464. Plaintiff entered into a written lease agreement with the defendant on or about November 30, 1971 for an apartment in defendant’s building. The lease and occupancy were to commence on March 1,1972. The building in which the apartment was located was under construction when the parties executed the lease.
