This is an action instituted by the plaintiff and respondent to recover from the defendant and appellant damages which the plaintiff claims to have suffered owing to the negligence of the defendant in maintenance and care of its streets. The complaint sets forth the defective condition of the street; the fact that plaintiff fell owing to the defedtive condition of such street, and that she sustained injury as the result of such fall.
