The plaintiff in error sought, by means of a possessory warrant, to recover possession of certain cattle alleged to be in the wrongful possession of the\ defendant in error. The case was tried upon the following statement of facts: “Plaintiff resides in Everett-springs district (1337) Floyd county, Georgia. Defendant resides in the same district, the. cattle in controversy being the property of plaintiff. Said cattle were allowed to run .at large, and, going upon the premises of defendant in said district, were impounded by defendant. Plaintiff found the cattle in the possession of defendant…
