This matter comes before the court on plaintiffs motion for judgment on the pleadings. (DE # 53). The issues raised are ripe for ruling. For the following reasons plaintiffs motion is granted in part and denied in part.

BACKGROUND

Plaintiff, a North Dakota corporation which presents itself as “one of the nation’s leading providers of air ambulance services,” and operates, among many others, two air ambulance services in northern South Carolina, near the North Carolina border, 1 initiated this case on June 18, 2007.
