Simmons, Chief Justice.

It appears from the record, that Mrs. A. Amos insured a certain house with the Hartford Fire Insurance Company, and that during the term for which the property was insured the house was burned. Samuel Amos brought an action on the policy, in which he alleged, among other things, that after the fire Mrs. Amos, for a valuable consideration, “transferred and assigned and delivered” the policy to the petitioner. A copy of the policy was attached to the petition. The defendant filed several special demurrers to the petition, one of them being that “it does not appear that…
