MEMORANDUM AND ORDER

CASTEL, District Judge.

This action arises out of an insurance coverage dispute between plaintiff Lava Trading Inc. (“Lava”) and defendant Hartford Fire Insurance Company (“Hartford”) stemming from damage to plaintiffs offices in One World Trade Center as a result of the terrorist attack of September 11, 2001. Lava seeks a declaratory judgment based on certain policy provisions, and seeks to recover damages for breach of contract, violations of the New York State General Business Law, and consequential damages as a result of defendant’s alleged breach.
