I. INTRODUCTION
On February 28, 2008, this court granted an ex parte order attaching the assets of defendant Ranhill Engineers and Constructors Sdn. Bhd. (“REC”). REC now moves to vacate that attachment. For the following reasons, the order of attachment is vacated.
II. BACKGROUND
A. The Logistics Agreement
On July 27, 2006, F.H. Bertling Holding KG (“Bertling”), a German holding company, and REC, a Malaysian construction company, entered into a Logistics Agreement that applied to three of REC’s upcoming construction projects, including a…
