This is an action for personal injuries resulting from *43an automobile accident which occurred on. June 18, 1933. The plaintiff was riding with the defendant, in defendant’s car, as his invited guest. Thus, the situation is within the purview of section 39-1129, Comp. St. Supp. 1933, the so-called “invited guest statute.” So far as applicable to the present case, it provides, in effect, that the owner or operator of a motor vehicle shall not be liable for any damages to any person riding in said motor vehicle as a guest and not for hire, unless such damage is caused by the gross negligence of…
