Plaintiff, Anna Paxton, a sister-in-law of the wife of William H- Smoke, deceased, filed a claim against his estate in the county court to recover damages for personal injuries allegedly sustained while riding in a 1935 LaSalle sedan automobile owned and operated in an alleged grossly negligent manner by William H. Smoke during his lifetime. The claim was disallowed by the county court, and plaintiff appealed to the district court. There the issues were presented to a jury and at conclusion of plaintiff’s evidence, defendant moved for directed verdict upon the ground that plaintiff’s evidence…
