This is an appeal from a decree of the court below dismissing a bill in equity filed by David C. Hick, appellant, for an accounting of rents and profits from real estate of which he claims to be the owner.

On August 12, 1907, appellant, and Mary E. Hick, his wife, owned premises 210 Sandusky Street, in the. City of Pittsburgh, as tenants by the entireties. Representing himself to be the sole owner and without- the joinder or knowledge of his wife, appellant, on that date, executed a bond and mortgage upon the property to the .Ben Franklin Insurance Company of…
