The defendants in error, plaintiffs below, brought their action against plaintiff in error in the superior court of Shawnee county, for their commission for selling lands for defendant. They alleged that they were real-estate agents; that the defendant came to them in the spring of 1884, ánd placed his farm in their hands for sale. The agreement entered into between the parties was not in writing, and the parties differ in regard to its terms.
