Appeal from a judgment of the superior court for Yakima county, Preble, J., entered January 20, 1912, in favor of the plaintiff, in an action to quiet title, tried to the court.

On November 9,1905, Priscilla Lee, the owner of certain lots in North Yakima, entered into a contract for the sale of the lots to William Manheim for $7,500. The contract provided for the payment of $500 in cash, and the remaining $7,000 was to be paid on or before May 9, 1906, when a deed would be given. The contract is in the usual form of executory contract for the sale and purchase of land. It provided that time was of the essence, and that, on default of the vendee, the vendor might declare a forfeiture.
