The ground upon which the appellant based his application for writs of habeas corpus and certiorari was that his trial and conviction were in violation of his rights under the Constitution and laws of the United States, in that the grand jurors, who returned the indictment, and the petit jurors by whom he was tried, were drawn from lists from which were excluded,, because of their race and color, all citizens of African race and descent.
