OPINION

2Per curiam

Phillip P. Ettinger appeals from the final judgment of the district court in favor of defendant Milvets Systems Technology (Milvets) on Ettinger’s claims for breach of contract arising from a business venture involving Ettinger and Milvets. Ettinger also seeks to appeal from the judgment of the district court denying Ettinger’s pretrial motion for summary judgment. We decline to review the district court’s sum mary judgment order and we affirm the district court’s judgment for Milvets on the merits of Ettinger’s breach of contract claims.
