Plaintiff I.A.M. National Pension Fund, Benefit Plan C (“the Plan”) brought this action against defendant Schulze Tool and Die Company (“Schulze”) to collect both monthly contributions and withdrawal liability which the Plan claims Schulze owes to it under the provisions of the Employee Retirement Income Security Act (“ERI-SA”), 29 U.S.C. § 1001 et seq., as amended by the Multiemployer Pension Plan Amendments Act of 1980 (“MPPAA” or “the Act”).
