Petitioners are husband and wife. The latter, herein referred to as “ the wife ”, is the natural mother of a girl nearly seven years old when this proceeding was begun, and has joined in her husband’s petition to adopt said infant. The wife’s first husband has been made respondent, and he objects to the adoption. The second husband, hereinafter referred to as “ petitioner ”, asserts that respondent lacks the status required to entitle him to object to the adoption, because (1) he is not in fact the father of the child and (2) he has abandoned her.
