Heretofore the petitioner, Peter J. Devine, moved before me for the recount and recanvass of the ballots cast in the primary election held in the city of Long Beach, county of Nassau, on the 16th day of September, 1937, for the nomination for Demo*667cratic candidate for the office of supervisor, wherein the petitioner was defeated by four votes. That motion was granted (N. Y. L. J., Oct. 1, 1937). The Appellate Division of this Department reversed the order entered thereon (252 App. Div. 756).
