McGOWAN, Circuit Judge:

The appeal in No. 20,504 from a grant of summary judgment by the District Court is a further round in a litigation which has engaged the attention of courts at all levels of the federal system. The controversy is over the discharge of appellant, a civilian employee, by the Air Force in 1959. Having failed of relief at the Civil Service Commission, appellant sued in the District Court for reinstatement and back pay. He was before us first in Williams v.
