KERNER, Circuit Judge.

Plaintiffs brought suit under the Fair Labor Standards Act, 29 U.S.C.A. § 201 et seq., for unpaid minimum wages, etc., under § 16(b) of the Act, claiming they were employees engaged in interstate commerce or in the production of goods for interstate commerce within the meaning of the Act.

Defendant is a national banking association and owns and operates an eighteen story building in Chicago, Illinois. In the conduct of its banking business it occupies certain portions of the building, the balance of which it leases to various individuals and corporations, none of whom…
