This is the second appeal of this case. See Box v. Associates Investment Co., Tex.Civ.App., 352 S.W.2d 315.

Associates Investment Company brought this action against Cloyce Box and Boyce Box, alleging that they were partners doing business as Box Auto Sales. Plaintiff’s action was based on certain promissory notes which had been executed by various makers and payable to the order of Box Auto Sales.
