PRETTYMAN, Associate Justice.

Anna R. Shoemaker died May 4, 1927, leaving considerable property and a will. *586By the will she bequeathed cash legacies to relatives, friends and charities and devised and bequeathed her residuary estate to a trustee, appellee here. The residue consisted principally of real estate, all of which was improved except three lots located at the corner of Wisconsin Avenue and Bran-dywine Street in the District of Columbia. The provisions of the will relating to the trust were contained in Item Ninth, the pertinent parts of which are as follows:
