Plaintiff below filed a suit for mandamus against the members of the commissioners’ court of Montague county. He alleged that theretofore he had secured a judgment against Montague county and road district No. 3 of said county for damages arising from the taking of a part of his land by the county, and that the judgment of the district court had been affirmed by the Court of Civil Appeals (241 S.
