Relators, as residents and owners of real and personal property in defendant’s school district, appeal from a judgment order denying their application for leave to file a complaint in Quo Warranto under the provisions of Ill. Rev. Stat. 1967, ch. 112, pars. 9, et seq. The application was originally filed as Count V of a five-count complaint and severed for trial. This action challenged the authority of the school board to issue tax anticipation warrants when, allegedly, there was money in the treasury. Violation of Ill. Rev. Stat. 1967, ch. 85, pars. 901, et seq. is charged.
