OPINION

In this diversity action, the plaintiff Richard Space, Sr., seeks to recover damages on his own behalf, and on behalf of his two children, Richard Space, Jr. and Michael Space, for injuries sustained by the two children while on the defendant National Railroad Passenger Corporation’s (hereinafter “Amtrak”) property. Jurisdiction is predicated upon 28 U.S.C. § 1332. The case is currently before the Court on the defendant’s Motion for Summary Judgment made pursuant to Fed.R.Civ.P. 56.
