The plaintiff claims the ownership and right of possession of' one hundred three-year-old steers, which constitute the property in controversy, by virtue of a chattel mortgage, executed on the' fourth day of February, 1898, by E. M. Donaldson, to secure the payment of a promissory note for the sum of five thousand dollars.
