Defendant Detroit Police Sergeant Charles Powell appeals as of right a judgment in favor of plaintiffs, entered pursuant to a jury verdict, in this action arising out of the entry and search of plaintiffs’ home without a warrant by members of the Detroit Police Department. The instant appeal arises from the trial court’s decisions denying Powell’s motions for a directed verdict and judgment notwithstanding the verdict (jnov) on plaintiffs’ claims for damages for the alleged violation of plaintiffs’ rights under the Michigan Constitution.
