This case involves the title to an undivided one-third interest in the allotment of Itosanna Canard who was a Creek Indian of the full-blood and enrolled opposite No. 4969 of the authenticated roll of said tribe, and died intestate on November 26, 1899, and left her surviving as her sole and only heirs at law her husband, Billy Canard, and three children, Katie, Lucy, and Joseph, all of whom are duly enrolled as fullJblood Creek Indians.
