This is an action to recover rents from defendant, alleged to be due under a lease of the west half of a building in the City of Stockton. From the findings it appears that the City of Stockton was the owner of the land upon which the building was located; the plaintiff owned the building and paid ground rent to the city, and after the defendant had occupied the west half of the building, under his lease of the same from plaintiff, for about one month, the building was entirely demolished by one Edwards, without the consent of either plaintiff or defendant; but defendant knew that Edwards…
