In this action the defendant SMS Architects, hereinafter called the defendant, filed a plea in abatement on May 20,1974, wherein it was alleged that the same plaintiff as in this case, on or about February 14, 1972, brought an action in this court against the defendant and others, which case is presently pending before this court.
