This was an action brought by the receiver of a failed state bank to recover a stockholder’s statutory liability.

Among other allegations the petition filed February 5, 1931, charged that 120 shares of the capital stock of the Lebanon State Bank stood in the name of the estate of I. J. Finch, deceased, and that the same were held, possessed and voted by the defendant *115Herbert I. Finch, as owner; that the estate of I. J.
