On April 16, 1934, D. J. Baker brought suit against Moultrie Banking Company, to recover certain sums alleged to have been paid by him to the bank as interest which was in excess of the legal rate, and to recover also the legal interest which he claimed as forfeited on account of usury. The petition was in three counts.
