Defendant Guidant Corporation appeals from an order of the circuit court of Du Page County holding it in contempt of court for refusing to produce certain materials demanded by plaintiff Allianz Insurance Company. Guidant was assessed a fine of $100 per day for each day it refused to comply with the circuit court’s order. For the reasons that follow, we find that the circuit court correctly determined that (1) Illinois law applies in deciding whether the materials at issue are privileged and (2) under Illinois law, neither the…
