In a negligence action to recover damages for personal injuries, etc., plaintiff appeals from (1) a judgment of the Supreme Court, Queens County, entered January 26, 1976, in favor of defendant, upon a jury verdict, after a trial limited to the issue of liability only and (2) so much of a further order of the same court, dated May 30, 1975, as, upon reargument, adhered to a prior determination which denied plaintiff’s motion pursuant to CPLR 4404 for a new trial.
